Terms of Service
These terms govern your use of TaxReminder (the “service”), operated by Blue Ocean Marketing as TaxReminder.ca. By creating an account or using the service, you agree to them. If you do not agree, please do not use the service.
1. What the service does
You tell us about yourself and your businesses — province, fiscal year ends, registrations and similar details — and we calculate the Canadian tax deadlines that appear to apply, then remind you by email and, if you choose, SMS. Accounting firms can use the service to track deadlines across their clients.
2. Accuracy, and the limits of it
We work hard to get dates right, and we test them against CRA guidance. Even so:
- Deadlines are calculated from the information you enter. If that information is wrong or out of date, the dates will be too.
- Tax rules change, and individual circumstances create exceptions we cannot know about.
- Reminders may fail to arrive for reasons outside our control, including carrier filtering, spam filters, a full inbox, a changed number, or a service outage.
The service is an aid to your own record-keeping, not a substitute for it. You remain solely responsible for filing and paying on time. We are not liable for penalties, interest, or other consequences of a missed deadline.
3. Your account
- You must be at least 18 and provide accurate information.
- You are responsible for keeping your login credentials secure and for activity under your account.
- Tell us promptly at support@taxreminder.ca if you believe your account has been compromised.
4. Firm accounts and client data
If you use the service as an accounting firm, you may add clients and manage their deadlines. In doing so you confirm that you have the authority and consent required to provide us with their personal information, and that you will tell them their data is processed by TaxReminder. You are responsible for what your staff do under your firm account. We process client data on your behalf as described in our Privacy Policy.
5. Messages and consent
By selecting email or SMS reminders, you consent to receive them under Canada’s Anti-Spam Legislation (CASL). Message frequency depends on your own deadlines and settings. Standard message and data rates may apply to SMS.
What we send by SMS. Account and transactional messages only: reminders about your own upcoming Canadian tax filing and payment deadlines, and messages confirming or ending your SMS subscription. We do not send marketing or promotional text messages, and we do not send text messages on behalf of anyone else.
Delivery. Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and network, and we cannot guarantee that any individual message arrives or arrives on time — see section 4 on reminders.
You can stop messages at any time: reply STOP to any SMS, use the unsubscribe link in any email, or change your notification settings. Reply HELP to an SMS for assistance.
6. Acceptable use
You agree not to:
- Use the service unlawfully, or to store information you have no right to hold.
- Attempt to access another customer’s data, or probe or disrupt the service.
- Resell or redistribute the service except as a firm using it for your own clients.
- Upload malicious code, or attempt to overwhelm or reverse engineer the service.
7. Plans and payment
Personal accounts are free. Paid plans for individuals with multiple corporations, and for accounting firms, are described on our pricing page. Fees are quoted in Canadian dollars and exclude applicable taxes. Where billing applies, charges are made in advance for the period selected, and cancellation takes effect at the end of the current period. We do not provide refunds for partial periods unless required by law. We will give at least 30 days’ notice by email before changing prices for an existing subscription.
8. Availability
We aim to keep the service available and reminders flowing, but we do not guarantee uninterrupted operation. We may suspend access for maintenance, security, or to protect the service, and will try to give notice where practical.
9. Your data
You keep ownership of the information you enter. You grant us the licence needed to store and process it in order to provide the service. You can export or delete your data, and deleting your account removes your personal information as described in our Privacy Policy.
10. Limitation of liability
To the fullest extent permitted by law, the service is provided “as is”, without warranties of any kind, express or implied. We are not liable for indirect, incidental, or consequential damages, or for lost profits, lost data, or tax penalties and interest.
Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $100. Nothing in these terms excludes liability that cannot be excluded under applicable law, including under consumer protection legislation.
11. Suspension and termination
You may close your account at any time from your settings. We may suspend or close an account that breaches these terms, or where required by law. On termination your right to use the service ends, and your data is handled as set out in the Privacy Policy.
12. Changes to these terms
We may update these terms. If a change is material we will email account holders and update the date at the top of this page before it takes effect. Continuing to use the service after that means you accept the revised terms.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction, without affecting any rights you have under the consumer protection law of your own province.
